Sales through the Site are exclusively reserved for the Consumer Customer in accordance with Article 3 of the Consumer Code (Legislative Decree No. 206 of September 6, 2005), namely "the natural person acting for purposes unrelated to the entrepreneurial, commercial, handicraft or professional activity possibly carried out."
1. PURPOSE AND OBJECT
SUITE S.R.L. makes cosmetics of the highest quality, developed and produced in Italy with materials of primary value. SUITE S.R.L.'s products are unique and aim to involve the user in a sensory journey that gratifies touch and smell, giving unique emotions through exclusive shapes, colours and fragrances. SUITE S.R.L.'s products appeal to a sensitive, demanding, detail-oriented clientele and are intended for users who love beauty, art and made in Italy, and who intend to enrich their inner perceptions. SUITE S.R.L.'s creations are ethical, composed of raw materials of pro-environmental origin, cruelty free and nickel tested. These Conditions apply to all registrations, orders, and purchases made through SUITE S.R.L.'s website and govern the relationship between it and the user. SUITE S.R.L. may always modify these Terms and Conditions, but such modifications may apply only to new orders and not to those being processed. In the case of new orders, the user is therefore invited to check, before purchasing, whether these general conditions of contract have been modified, which will in any case be permanently accessible on the site.
2. CHARACTERISTICS OF THE PRODUCTS THAT CAN BE PURCHASED
SUITE S.R.L. offers for sale the services and products on its site (such as, by way of non-exhaustive example,
the BATH PASTRY products, such as MACARONS or the MALÌ SKINCARE products, in its BODY BUTTER,
SCRUB, BATH SALTS lines).
Each product can be purchased by following the procedure provided on the site, which may also include registration to access a reserved page within which the details and specifications of the product chosen by the user are given before purchase. SUITE S.R.L. is in any case not responsible for the failure to purchase the product due to errors and/or computer incompatibility of the user, who also remains responsible for the related software installed for the proper use of the site and its services. If foreseen, the user may subscribe to a mailing list or newsletter service even without purchasing any product; adherence to such a service will entail SUITE S.R.L. sending emails and/or other communications containing advertising information or topics pertaining to its products; the user may in any case unsubscribe from the mailing list or newsletter by following the procedures indicated on the site. The user may also be given the opportunity to access MALÌ's Facebook page or other social networks and to contact the owner of the site in accordance with the terms and conditions set forth therein.
It is specified that SUITE S.R.L. does not make medical products intended for personal care. The user expressly declares himself aware that the products of SUITE S.R.L. are in any case addressed to healthy people, in good health, of age, who have no medical preclusion and/or forms of allergy. Any possible risk should reverberate on the user's health is therefore attributed to the exclusive risk of the user, remaining SUITE S.R.L. free from any alleged legal responsibility should be charged to it, for any reason or title. It is also the user's sole responsibility to ascertain his or her physical fitness to use the services and products offered by SUITE S.R.L. and to use any other content on the site.
3. METHODS OF STIPULATION, CONCLUSION AND EXECUTION OF THE CONTRACT
The user may purchase the services and products of the Malí brand exclusively by telematic means, accessing the website of SUITE S.R.L. and following the procedures provided therein, including that relating to payment methods. The user accepts that, in order to purchase on the site, he/she must obligatorily register on the same according to the procedures provided therein and that the email used for registration will subsequently be used for all communications and the execution of the contract. The Contract for the purchase of the product and/or service is considered concluded when the user, following the procedures indicated, formalizes and forwards electronically, his or her purchase order, thus accepting the purchase proposal of SUITE S.R.L. By submitting the order, the user also declares himself or herself to be aware of these Conditions of Contract, which he or she declares to know and accept. The order will be considered processed with the payment of the purchased product. All orders are subject to a subsequent email confirmation, containing the details of the purchase, as well as the information required by current legislation and/or the Consumer Code on online sales.
4. SHIPMENTS and RETURNS.
Upon actual receipt of payment by the user, Suite s.r.l. will ship the purchased products in 3-5 working days, using leading companies in the logistics sector (including DHL, SDA, etc.) with shipping costs placed on the buyer, already indicated, accepted and charged to the user at the time of the conclusion of the order. Upon reaching certain amounts identified at the time of order conclusion, shipping may be free of charge. In the event that the withdrawal has been exercised and the return has been made in accordance with the terms of the law and the conditions provided for in Article 7 below, SUITE S.R.L. shall refund the payment received from the consumer, possibly including shipping costs, within fourteen days from the day on which it is informed of the user's decision to withdraw from the contract. SUITE S.R.L. will make the refund using the same means of payment used by the user for the initial transaction. SUITE S.R.L. may withhold the refund until it has received the goods, which must be returned before the expiration of the fourteen-day period. In any case, Article 59 of the Consumer Code applies, under which the withdrawal remains precluded if the user has opened, punctured, broken the package containing the goods purchased
5. PRICES, PAYMENT METHODS AND INVOICING
The prices of the products offered on the site are expressed in Euros, VAT included, and are calculated according to the order placed by the user. SUITE S.R.L. retains the right to change prices at any time, it being understood that the price published on the site on the day of the order will be the one applicable to the user at the time of purchase. The user shall make payment exclusively in accordance with the methods, procedures and payment methods indicated on the site. If, based on the type of service requested, it is necessary to proceed with the invoicing of the amount paid, the user shall provide, under his or her sole responsibility, the additional data required by SUITE S.R.L. in order to proceed with such fiscal fulfilment.
6. RIGHT OF WITHDRAWAL
You have a period of fourteen days to withdraw from the contract without giving any reason. The withdrawal period ends after fourteen days from the day you acquire physical possession of the goods or:
- in the case of multiple goods ordered through one order and delivered separately, from the day the user acquires physical possession of the last good;
- in the case of delivery of a good consisting of multiple lots or pieces, from the day the user acquires physical possession of the last lot or piece.
The user will be informed of the possibility of withdrawing from the contract by appropriate notice on the site when ordering the product. To exercise his right, the user must submit a written statement, sent to SUITE S.R.L., containing his explicit decision to withdraw from the contract.
SUITE S.R.L. will make the refund using the same means of payment used by the user for the initial transaction. SUITE S.R.L. may withhold the refund until it has received the goods, which must be returned before the expiration of the fourteen-day period. In any case, Article 59 of the Consumer Code applies, under which the withdrawal remains precluded if the user has opened, punctured, broken the packaging containing the purchased goods.
7. LIMITATIONS OF LIABILITY
The use and purchase of the services and/or products offered on the site take place under the exclusive responsibility of the user and, therefore, SUITE S.R.L. cannot be held responsible, for any reason and for any reason, for any damage and/or inconvenience, direct or indirect caused by the services and/or products offered and purchased by the user, including their use. The user is aware that the services and products offered by SUITE S.R.L. are not suitable for certain types of people, especially in the presence of pathologies and/or allergies or intolerances, for which the user is obliged in any case to consult his or her trusted doctor and, therefore, should the product and/or service be used not in accordance with what is requested, SUITE S.R.L. cannot be held responsible for any damage and/or inconvenience, however named, that the user may eventually complain of. SUITE S.R.L. shall not be liable to users for injuries, illnesses, physical or psychological discomfort and, more generally, for any damage that may be caused to the latter through the use of the products purchased.
8. PERSONAL DATA PROTECTION
By registering on SUITE S.R.L. website, the user gives his or her consent to his or her personal data processing, which will be processed by means of computer procedures and stored in special systems in the exclusive use and custody of SUITE S.R.L. The personal data provided will be used exclusively and only for the proper use of the service and will not be transferred to third parties for any reason whatsoever, except for the legal obligations provided for also in tax and fiscal matters. At any time, the user may request from SUITE S.R.L. the consultation, modification and deletion of their personal data, also exercising their right of opposition.

9. DATA INTEGRITY AND INTELLECTUAL PROPERTY
The user guarantees that the data and information provided in the execution of this contract are correct, lawful, truthful and complete, also in accordance with current privacy legislation and can therefore be legitimately communicated and used by SUITE S.R.L. in the execution of this contract, with express indemnity of the latter for any recourse, violation or damage however generated or connected to the use of the data provided by the Customer.
All the contents of the site are the property of SUITE S.R.L. Any type of reproduction, exploitation, diffusion, even of texts, videos, audios, is strictly prohibited. In case of violation, SUITE S.R.L. reserves the right to proceed against offenders before the competent judicial offices.
10. O.D.R. (Online Dispute Resolution)
In the event of disputes or complaints, the user can activate the online resolution of the dispute through the O.D.R. service, managed by the European Union and available at the following address: https://ec.europa.eu/consumers/odr/main/index .cfm?event=main.home2.show&lng=EN. In any case, the user can send a formal complaint to SUITE S.R.L. at the following e-mail address: info@malimilano.it
11. APPLICABLE LAW
For any other matter not governed by these general contract conditions, please refer, if applicable, to the provisions of the Consumer Code (Legislative Decree No. 205/2006) and in any case to Italian law.
